This Privacy Policy describes how Dark Skies Solutions (“we,” “us,” or “our”) collects and uses information in connection with the Dark Skies Solutions Workforce Communications SMS program. Surge is the technology platform used to operate this program. For this SMS program, Dark Skies Solutions is the organization responsible for the messages and for the mobile information collected at opt-in.

When you submit the form at dss.surge-command.com/sms-opt-in, we collect your first name, last name, and mobile phone number. You may also provide an email address. If you check the optional email-updates consent box, we store that choice separately, along with a timestamp and the consent wording you saw, so we can demonstrate what you agreed to. We also collect technical information automatically — including IP address and basic browser or device data — for security, abuse prevention, and compliance.

SMS. Your phone number and SMS consent are used to send the operational text messages described when you opt in — deployment opportunities, scheduling updates, training information, operational updates, account notifications, and other workforce communications. The legal basis is the consent you give on the form. Details are in our SMS Terms & Conditions.

Email. If you leave the email field blank or do not check the email-updates box, we do not treat your address as permission for email marketing. If you do opt in, we may send email about training opportunities, roster and deployment news, and notices about our systems. Message frequency varies. You may also receive occasional transactional email related to your relationship with us where permitted without additional consent.

Mobile information, including mobile phone numbers and SMS consent records, will not be shared with third parties or affiliates for marketing or promotional purposes. Information is used only to provide the SMS communications described in the SMS Terms & Conditions and on the SMS Opt-In page. This policy does not authorize sharing of your mobile information with unrelated customer organizations for their own messaging.

Marketing-style or newsletter-type email includes an unsubscribe link when required. You can also contact us using the email at the bottom of this page to ask questions or to request access, correction, or deletion of your personal data, subject to legal exceptions. Opting out of email does not automatically remove you from SMS — reply STOP to a text message to end SMS, or use the form again as described in the SMS Terms.

We share data only as needed to run our services — including with Twilio (SMS delivery) and SendGrid (email delivery when we send mail from our systems). Surge is the technology platform used to operate the program. We do not sell or rent your personal data.

Your data is stored and processed in the United States. By submitting the opt-in form, you acknowledge that your information may be processed in the US, where data protection laws may differ from those in your country of residence.

We store opt-in records, including consent timestamps and the exact disclosure text presented, using industry-standard practices. Records are retained for compliance and audit purposes in line with applicable law and operational needs.

You may opt out of SMS at any time by replying STOP to any text message from this program. For email you agreed to receive, use the unsubscribe link in those messages where provided, or write to us. To request access to, correction of, or deletion of your personal data, contact us at dss@surge-command.com. We will respond to verified requests within a reasonable timeframe.
